Privacy Statement
The One and Only Corporation , brand name Zeer ("we", "us" or "our"), respects and is committed to protecting your privacy. That is why we have adopted this Privacy Statement. This Privacy Statement provides an overview of what information we may collect from you, and how we may use it. We pledge that we will take reasonable steps to ensure that your personal information will only be used in ways that are in compliance with this Privacy Statement.
This Privacy Statement applies to the personal information that we collect from users of our products, services and websites, including our website located at www.zeersafe.com (the "Site"), our mobile application (the "Mobile App"), and all related tools, applications, data, software and other services provided by us currently or in the future (collectively, including the Site and the Mobile App, the "Web Properties").
1. What is "Personal Information"?
Personal information is information that we hold about you, and which identifies, or together with other information may identify, you, such as your name, phone number, geolocation while using the Mobile App, your emergency contact information, and any medical information that you input into the Mobile App to share with first responders.
2. Information That We Collect.
Below are examples of the types of information that we collect about you and the different ways in which we use that information:
(a) Information that you provide to us, including:
(i) Registration Information.
When you sign up for our services, we will ask you for certain information, including a username and password, your email address, phone number, certain information about your cell phone, state of residence, geolocation data while you are using the Mobile App, and medical information that you add to the Mobile App, including your sex, blood type, allergies, chronic conditions, medications, and emergency contact information. This information is necessary for us to provide the services to you. If you do not provide this information, we will not be able to provide certain services to you.
(ii) Social Media Log-In Information.
If you choose to connect to the Web Properties using credentials from a third party service such as Facebook, Google, Apple or LinkedIn (each, a "Third Party Service"), we will need to collect authentication information and encrypted access credentials. For each Third Party Service, we ask for information such as your user name or account email address and access to your public profile data, including your profile photo.
We use this information to identify you in your use of our services. For example, we may take your Third Party Service profile photo and present it alongside your Third Party Service email address.
(iii) Feedback.
Any feedback, questions, comments, suggestions, ideas, or the like that you send to us. All such submissions are treated as non-confidential and non-proprietary and we may use them and share them with third parties. This is described more fully in our Terms of Use [www.zeersafe.com/terms].
(b) Information We Passively Collect from You – Usage, Log, Cookies.
When you use our services, we may use cookies and similar technologies to collect information about your location, your application, your activities on the Web Properties, information about your device, and log information. This is described in more detail in the "Cookies and Other Technologies" Section below. The information collected may include:

Location Information: Information about your estimated geographic location, which may be deduced by various technologies including your IP address.

Application Information: The unique identifier assigned to your application by the relevant app store, information about the app meta data of your application, and your application's marketing materials publicly available on various app stores.

Activity data: This includes information, such as the time of an event, how you reached the Web Properties, what search engine and search keywords you may have used to get to the Web Properties, which pages you visit on the Web Properties, and your activities on the Web Properties. We also collect information regarding the actions you take with respect to emails that we send to you, such as when you open them and what you click in them (if anything).

Device Information: Information about the device that you are using, such as the hardware model, operating system, application version number and browser, mobile network information, IP addresses, user names, real names, email addresses and other custom attributes.

Log Information: Server logs regarding how you use the Web Properties or the service, including such things as when you record a video, the length of any videos recorded, location, heart rate, accelerometer, connected IoT devices, how a user interacts with the device including hardware button interaction, screen pressure, audio clues such as safe words, gunshots, sound of violence, etc., geofencing, geolocation, etc., device event information such as crashes, system activity, hardware settings, browser type, browser language, and cookies that may uniquley identify your browser or device.
(c) Google Analytics
We may use a tool called "Google Analytics" to collect some of the information listed above about your use of the Web Properties and/or our service. We use the information that we obtain from Google Analytics to improve our services and to help you by improving the Web Properties. In order to collect this information, Google Analytics may set cookies on your browser or mobile device, or read cookies that are already there. Google Analytics may also receive information about you from apps that you have downloaded, that partner with Google. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google's ability to use and share information collected by Google Analytics about your visits to the Web Properties, or to another application that partners with Google, is restricted by the Google Analytics Terms of Use and the Google Privacy Statement. (d) Information We Collect from Third Parties
We may use LinkedIn Sales Navigator to locate and connect with individuals who may find our services to be of value. You may decline such requests or remove the connection at any time. You can control which messages you receive by adjusting your communication preferences on the LinkedIn Privacy Settings page or using the unsubscribe options in the footer of messages, as applicable.
3. How We Use Personal Information.
We use personal information to provide our services to you, to improve the Web Properties and to protect our legal rights. We limit the collection of personal information to that which is relevant for the these purposes. We will not store, access, transmit, retain or otherwise use personal information in any way that is incompatible with the purposes for which it has been collected or stored as described in this Privacy Statement, unless such alternative use is authorized in writing.
To the extent that European Union ("EU") data protection law applies to our processing of personal data about you as user of the Web Properties, we act as the "data controller".
We use your information in order to:
(a) Provide the services to you.
To do this, we also use your information to provide you with technical support and assistance in your use of the services, ensure that the services function correctly and communicate with you about the services by email, forums, and other notifications. For example, we will contact you to notify you of any issues with the services or any suspicious activity in your account. The legal basis for these uses is the performance of the contract with you.
(b) Improve the Services.
We may use your information for analytics and measurement to understand how our services are used in order to make improvements to our services or develop new aspects or features of the services through understanding how you use and interact with them, including how you interact with applications, advertising, products, and services that are made available, linked to, or offered through the services.
We use information about how you use the services in order to prevent or detect fraud.
The legal basis for these uses is our legitimate interest in the improvement and optimization of our service offerings and in ensuring the security of our services. We apply appropriate safeguards to protect your information. (See Section 6 below.)
(c) Comply with legal requirements and protect our rights
When needed, we use your information to enforce this Privacy Statement, the Terms of Use [www.zeersafe.com/terms] and any other terms that you have agreed to, including to protect the rights, property, or safety of The One and Only Corporation, Zeer users, or any other person, as well as to comply with our legal obligations.
The legal basis for these uses is our legitimate use in the performance of our contractual obligations, the protection of our legal rights, compliance with legal obligations, and protection of the rights of users and other individuals.
(d) Tell you about our new products or services
If you agree, we will contact you by email to inform you of new products and services that might be of interest to you. You can opt out of receiving such email communications at any time by clicking the "unsubscribe" link at the bottom of each email or by contacting us at [email protected].
Our representatives may send you connection requests or messages on social media. You may decline such requests or remove the connection at any time.
4. How we Share the Information Collected.
We share information collected with service providers that assist us with the provision of our services, as well as in connection with a business transaction or as necessary to comply with our legal obligations.
(a) With Service Providers
We share your information with service providers to perform functions and process your data and to help provide our services, consistent with this Privacy Statement. For example, we work with service providers to host the Web Properties. Such services may include Amazon Web Services, Facebook and Google. We also work with analytics providers, including Google Analytics (see above) to help us understand your use of our services. The legal basis for this sharing of your information is our legitimate interest in providing our services efficiently.
Any information that we provide to third party services is protected by an appropriate agreement ensuring that it will only be used for the purposes for which it was provided. When we receive personal information under the Privacy Shield, as explained below, and then transfer it to third party services, we are liable for any processing of personal information by those third parties that is inconsistent with the Privacy Shield Principles, unless we are not responsible for the event giving rise to any alleged damage. In addition, we apply appropriate safeguard to protect your information (see Section 6 below).
(b) With our affiliates and in connection with a business reorganization
We share your information with our parent company, subsidiaries, joint ventures, and/or other companies under common control with The One and Only Corporation in the ordinary operation of our business. In addition, we would share your information if we were involved in a merger, acquisition, consolidation, change of control or sale of all or a portion of our assets or if we undergo bankruptcy or liquidation. The legal basis for this sharing is our legitimate interest in carrying out our business operations.
(c) 5.1.2 Legal: Privacy - Data Use and Sharing
We do not track your your data across other applications without your express permission so Zeer can work properly. We do not share your data with any other apps or companies unless they are owned and operated by us to fulfill our promises to you and without your expressed permission.
(d) In order to comply with our legal obligations, protect our rights and those of others
We share your information pursuant to your instructions, in order to prevent fraud or abuse to our services, to protect your rights, to comply with our legal obligations and to protect our rights. The legal basis for this sharing is compliance with the law and our legitimate interest in the prevention of fraud, compliance with legal obligation, and the protection of the rights of others.
(i) Pursuant to your instructions: When requested, we will share or facilitate the sharing of your information with third parties pursuant to your instructions. We do not have any legal relationship with such third parties. You are responsible for entering into separate contractual arrangements with such third parties binding them to comply with data protection obligations. These third party data processors are not sub-processors and we will not bear any responsibility or liability for sharing information with such third parties. The legal basis for this sharing is necessary for the performance of our contract with you.

Prevent fraud and abuse of the Services: We will share information to prevent or detect fraud or to address technical issues and, if we believe that it is necessary, to investigate, prevent, or take action regarding situations that involve abuse of the Web Properties, our services, or the Internet in general (such as voluminous spamming, denial of service attacks, or attempts to compromise the security of the Web Properties infrastructure or the services generally).

Protect your rights: If you ask that we do so, we will share information in an emergency situation.
(iv) Protect our rights and comply with our legal obligations: We will share information if we are legally required to do so, such as in response to a court order or legal process (e.g., a court order or subpoena), or to establish, protect, or exercise our legal rights or to defend against legal claims or demands, or to comply with requirements of mandatory applicable law. We will also share information as necessary to enforce this Privacy Statement, the Terms of Use [www.zeersafe.com/terms], and any other terms that you have agreed to, including to protect the rights, property, or safety of The One and Only Corporation, its users, or any other person.
We may also process and share information in an aggregated, de-identified manner, where the information is shared as part of a statistical report and does not contain any personally identifiable information

(v) Sharing Information with Social Media Services:
If you have given us permission in connection with using third party services for the purpose of signing in, or on your preferences set with those third party service, some information about you can be shared with social media services and with others through third party services and may be published by them or may be shared by default. You understand and agree that a third party service's use of information collected from you (or as authorized by you) is governed by that third party service's privacy policies and your settings on the relevant service, and that our use of such information is governed by this Privacy Statement and your account settings on or through the Web Properties.
5. Third Party Links
The Web Properties may contain links to third party websites that we do not own or control. We have no control over the content, privacy policies, or practices of any third party site. We are not and cannot be responsible for the privacy practices or the content of any of those websites. You are subject to the policies of those third party websites where applicable. We encourage you to ask questions before you disclose any Personal Information.
6. Member Account, Password and Security
For certain features available through the Web Properties, we may require the use of encryption technologies provided for your protection and/or your use of a UserID and password after setting up a User Account. We use reasonable precautions to protect the privacy of your UserID, password and User Account information by utilizing an SSL connection. Accordingly, your UserID, password and User Account information are encrypted using an SSL connection and are not expected to be read in an intelligible form as they travel to the Web Properties. You, however, are ultimately responsible for protecting your UserID, password and User Account information from disclosure to third parties, and you are not permitted to circumvent the use of required encryption technologies. You agree to immediately notify us of any unauthorized use of your UserID, password and/or User Account, and/or any other breach of security. While we may provide certain encryption technologies and use other reasonable precautions to protect your confidential information and provide suitable security, we do not and cannot guarantee or warrant that information transmitted through the internet is secure, or that such transmissions are free from delay, interruption, interception or error.
7. Statement Regarding Children
The Web Properties are not intended or designed to attract children under the age of thirteen (13). We do not collect personally identifiable data from any person that we know to be under the age of thirteen (13) without parental consent. If we learn that a user under the age of thirteen(13) is publicly posting or sharing personally identifiable information in or through the Web Properties without parental consent, then we will use commercially reasonable measures to block that user from using the Web Properties.
Parents should be aware that this Privacy Statement will govern our use of Personal Information, but also that information that is voluntarily given by children – or others – in chat sessions, email exchanges, bulletin boards or the like may be used by other parties to generate unsolicited communications. We encourage all parents to instruct their children in the safe and responsible use of their Personal Information while using the internet.
8. Cross Border Transfers
We may transfer, process and store information about you on servers located in a number of different countries, including the United States. We may also subcontract the processing of your information to, or share your information with, third parties located in countries other than your home country.
(i) Transfers of Information from the EEA
We will conduct any transfers of personal information from the European Economic Area (EEA), from the United Kingdom, or from Switzerland to the US in compliance with relevant data protection laws.
(ii) Transfers of Information Not from the EEA
To the extent that personal information is transferred to the United States from countries other than countries within the European Economic Area, UK, and Switzerland, including personal information that is transferred from Canada, we employ similar safeguards, such as selecting third party vendors carefully, ensuring that personal information will be used and disclosed only as set out in this Privacy Statement and that it is protected by appropriate security safeguards.
However, in connection with these transfers of personal information, your personal information may be subject to privacy laws that may not provide the same level of protection as may be available in your country of residence. For example, government entities in some other countries may have certain rights to access your personal information. By using the Web Properties or our services, you are consenting to this transfer of your personal information.
9. Data Subject Rights
If you are a user of our services and reside in the EU, UK, or Switzerland, you are entitled by law to access, correct, amend, or delete personal information about you that we hold. A list of these rights is set forth below.
You may access your Zeer account to access, correct or delete the information that you provided to us and that is associated with your account. For instructions on accessing your information or otherwise for assistance with these rights, please contact us at [email protected].
If you request access to your information and we refuse, we will tell you why your request was refused. Individuals in the EU have the right to complain as outlined in Section 18 below.

(a) For EU, UK, and Swiss Individuals: Your Rights Under Privacy Shield
The One and Only Corporation (“Zeer”) complies with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union, the United Kingdom, and Switzerland to the United States in reliance on Privacy Shield. The One and Only Corporation has certified that it adheres to the Privacy Shield Principles with respect to such data. If there is any conflict between the policies in this privacy policy and data subject rights under the Privacy Shield Principles, the Privacy Shield Principles shall govern. With respect to personal data received or transferred pursuant to the Privacy Shield, we are subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission.
If we become subject to an FTC or court order based on non-compliance, we will make public any relevant Privacy Shield-related sections of any compliance or assessment report submitted to the FTC, to the extent consistent with confidentiality requirements.
Pursuant to the Privacy Shield Frameworks, EU, UK, and Swiss individuals have the right to obtain our confirmation of whether we maintain personal information relating to you in the United States. Upon request, we will provide you with access to the personal information that we hold about you. You may also correct, amend, or delete the personal information we hold about you. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data transferred to the United States under Privacy Shield, should direct their query to [email protected]. If requested to remove data, we will respond within a reasonable timeframe.
We will provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. For more information, please see Section 4 above called "How we Share the Information Collected."
The One and Only Corporation’s accountability for personal data that it receives in the United States under the Privacy Shield and subsequently transfers to a third party is described in the Privacy Shield Principles. In particular, The One and Only Corporation remains responsible and liable under the Privacy Shield Principles if third-party agents that it engages to process personal data on its behalf do so in a manner inconsistent with the Principles, unless The One and Only Corporation proves that it is not responsible for the event giving rise to the damage.
In compliance with the Privacy Shield Principles, The One and Only Corporation commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States under the Privacy Shield. European Union and Swiss individuals with Privacy Shield inquiries or complaints should first contact us at [email protected].
The One and Only Corporation has further committed to refer unresolved privacy complaints under the Privacy Shield Principles to an independent dispute resolution mechanism, the BBB EU PRIVACY SHIELD. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit https://bbbprograms.org/privacy-shield-complaints/ for more information and to file a complaint. This service is provided free of charge to you.
If your Privacy Shield complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. 10. What You Can Do about Our Use of Your Information.
(a) Email communication: You can opt out of receiving promotional email communications from Zeer by clicking the "unsubscribe" link included in each email. We will continue to send notifications to this email address to the extent necessary for the services that we provide to you.
(b) Cookies and trackers: For information on how to opt out of the collection of some information about you, see below in the Section entitled: "Cookies and Other Technologies – What Can You Do About Them?"
(c) Deleting your account: You may ask that we delete your account by contacting us at [email protected]. If you ask us to delete your account, we will begin the process of deleting your account from our systems.
11. How Long Do We Keep Your Information?
We retain your information for longer periods for specific purposes to the extent that we are required to do so in accordance with applicable laws and regulations and/or as necessary to protect our legal rights or for certain business requirements. For example, when we process your payments, we will retain this data for longer periods of time as required for tax or accounting purposes. In particular:

Security, fraud & abuse prevention – i.e. to protect you, other people, and The One and Only Corporation from fraud, abuse, and unauthorized access.

Financial record-keeping – When you make a payment to us, we are often required to retain this information for long period of time for purposes of accounting, dispute resolution and compliance with tax, anti-money laundering, and other financial regulations.

Complying with legal or regulatory requirements – to meet any applicable law, regulation, legal process or enforceable governmental request, as required to enforce our terms of service, including investigation of potential violations.

Ensuring the continuity of our services - For example, when you share information with other users, deleting it from your account will not eliminate copies maintained by the recipients.

Direct communications with us - if you have directly communicated with us , through a customer support channel, feedback form, or a bug report, we may retain reasonable records of those communications.
Even if you delete your account, please remember that the deletion by our third party providers may not be immediate and that the deleted information may persist in backup copies for some period of time. 12. Cookies and Other Technologies
(a) What Are They?
Cookies are text information files that your web browser places on your computer, mobile phone, or other device when you visit a website or mobile app. These cookie will help the website or mobile app recognize your device the next time you visit that website or mobile app. There are other similar technologies such as pixel tags (transparent graphic images placed on a web page or in an email, that indicate whether it had been viewed), web bugs (similar to pixel tags), and local storage objects (using mechanisms such as browser web storage (including HTML 5) and application data caches), which are used in desktop software or mobile devices.
(b) What Do We Use Them For?
Currently, we do not use cookies on the Mobile App. However, we may use them on the Site. We and our third party providers use both session cookies (that expire once you close your web browser) and persistent cookies (which stay on the device for a set period of time or until you delete them) in order to operate our services, and in order to optimize them through the performance of analytics. Cookies fall into the following categories:
Required
These cookies are required for making use of our services. These cookies include security cookies to authenticate users, prevent fraudulent use of login credentials, and protect user data from unauthorized parties, as well as session cookies that remember your log-in session so you can move easily within the Site.
Functional
These cookies record some of your activity on the Site as well as information about your device, such as what browser you are running, and what pages you access. This information helps us and our third party service providers diagnose server and software errors, and in cases of abuse, track and mitigate the abuse.
Analytics
Our service providers, including Google Analytics, use cookies as part of their tools. These cookies allow our service providers and us to recognize and count the number of users of the services, to see how they move around the Site, and how they engage with different functions, including usage statistics, when they are using the services. This helps us to improve the way our services work, for example by making sure our users are finding what they need easily.
(c) What Can You Do About Them?
Most browsers accept cookies automatically, but can be configured not to accept them or to indicate when a cookie is being sent. Please note that, if you choose not to accept any cookies, you may not be able to take full advantage of all of the features of the Site or use our services. General: Most browsers accept cookies automatically, but can be configured not to accept them or to indicate when a cookie is being sent. Turning off a browser's cookies will prevent web beacons from tracking your specific activity. The web beacon may still record an anonymous visit from your IP address, but unique information will not be recorded. If you do not want to receive tracking pixels, you will need to disable HTML images in your email client, and that may affect your ability to view images in other emails that you receive. 13. Your California Privacy Rights
Under California's "Shine the Light" law, California residents who provide personal information in connection with obtaining products or services for personal, family or household use are entitled to request and obtain from us once per calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g., requests made in 2020 will receive information regarding 2019 sharing activities).

Please be aware that not all information sharing is covered by the "Shine the Light" requirements and information on covered sharing will be included in our response and, at our discretion, possibly other information.
14. Do Not Track Requests
The Web Properties recognize "Do Not Track" requests. Do Not Track (DNT) is a privacy preference that you can set in your web browser to indicate that you do not want certain information about your webpage visits collected across websites when you have not interacted with that service on the page. 16. Governing Law
This Privacy Statement will be governed by the laws of the Commonwealth of Pennsylvania, without giving effect to any principles of conflicts of laws. By using or accessing the Web Properties or using our service, you agree that any action at law or in equity arising out of or relating to your use of the Web Properties or this Privacy Statement will be filed only in the state or federal courts sitting in Philadelphia, Pennsylvania, and you hereby consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action.
17. Changes to Privacy Statement
We may change this Privacy Statement from time to time. We will not reduce your rights under this Privacy Statement without your explicit consent. When we update this Privacy Statement, we will notify you by posting the revised Privacy Statement on the Web Properties and will always indicate the date on which the latest changes took effect. If changes are significant, we will provide a more prominent notice, including directly notifying you by email of the change (sent to your last known email address). Your continued use of the Web Properties after the changes have been made will constitute your acceptance of those changes. Please, therefore, make sure you read any such notice carefully. If you do not wish to continue using the Web Properties under the new version of this Privacy Statement, please stop using our services.
